The Supreme Court, Barack Obama and the GOP

Obama has made his decision, nominating Judge Sonia Sotomayor to be the new Supreme Court Justice.

From a purely political standpoint, I think this is a genius move on the president’s part.

The GOP, already somewhat hampered due to the stink they made over filibusters during Justices Roberts and Alito’s confirmation hearings, can only complain so much- regardless of whom Obama names- because they don’t want to look like complete hypocrites.

During the Bush Administration, they wanted a simple up-or-down vote for judges… and… well, now they have the opportunity to put their money where their mouth is.

Normally, especially in politics, hypocrisy would be par for the course- something the Republicans need not think twice about. Currently, however, they stand to lose even more than they can afford to, considering that the GOP’s already critically injured.

Their party is on life-support.

The GOP needs the support of the Latino community… which is exactly Judge Sotomayor’s background. How can they justify fighting to exclude a woman who is Catholic, Latina, and more experienced than either justices Roberts or Alito were at the time of their confirmations?

I don’t think they can.

Gingrich can scream that Judge Sotomayor is racist all he wants to… that seems to be his current plan of attack… but really, no one’s listening to that nonsense.

Personally, the thought of another Catholic on the bench- we currently have 5, not including Sotomayor- makes me a little nervous.

Catholics typically don’t support a woman’s right to choose, gay rights or stem cell research… all things that are very important to me. Sotomayor has not had the opportunity to rule much on those issues, so we don’t really know for sure where she stands.

Hopefully, if confirmed, she will keep her religious beliefs off the bench, ruling instead to preserve the rights of all people- recognizing that the freedom to make individual decisions for ourselves is a bigger priority than exulting her own beliefs from on high.

The greater good and all that.

On the flip side, Catholics tend to be adversaries of the death penalty, and that’s something I would love to see abolished… so who knows…

It would have been nice to see a good lesbian, protestant judge nominated, but I do realize we don’t yet live in a country where such an individual’s confirmation would have been possible.

Still… a person can dream, right?

Tryin' to get the hang of this life thing... one step at a time!

  1. Great post. The only thing is, some blogs I’ve come across are parroting the “racist” junk.
I’d say we’re about ten million years away from your last point, unfortunately.
    Very, unfortunately…

  2. Hey C Haze,

I just thought I’d point out that Sotomayor is a member in ‘La Raza’. That is the organization that was responsible for all the Mexican flag waving during those protest not to long ago. Then a day or two after all the controversy over the flags, they where switched to American flags.

The group’s name translates to The Race. There are also some secondary organizations within La Raza.
Such as the radical racist group Movimiento Estudiantil Chicano de Aztlan, or Chicano Student Movement of Aztlan (MEChA), one of the most anti-American groups in the country, which has permeated U.S. campuses since the 1960s, and continues its push to carve a racist nation out of the American West.

MEChA was in fact reported to be one of the main organizers of those street demonstrations. Their motto,
“Por La Raza Todo, Fuera de La Raza Nada.”
“For the Race, Everything; Outside the Race, Nothing.”
Their stated plan is what is referred to as the “Reconquista” or reconquest, of the Western U.S.

Now I am fine with a civil rights group. We need them. However, this group has to many radical ties. Indeed nominating Judge Sonia Sotomayor was a political move that I don’t think can be countered. Its a check but not a check mate. Its pretty close to a check mate though. I would be careful about being to excited about her. She stated flat out that individual States do not have to respect the Constitution. That is a gross misunderstanding and any Constitutional Scholar knows that. The federal government is sending billions to States and in turn demanding certain controls that they are not afforded by our Constitution, this is why many States passed Resolutions to reaffirm their sovereignty just recently. Just something to think about. Sometimes victory can have a sour taist.

    1. Hey There SpiritOfTruth-

You’ve definitely given me some stuff to research! I don’t know a ton about her… and like I said in my post, on a personal level, I’m not ready to wholeheartedly endorse her.

I’m also not ready to flog her either…

… still got lots of learning to do!

Seems we both agree on one thing- Obama’s nomination of her, speaking from a political strategical view- was pure genius.

The GOP’s kinda’ handcuffed at this point.

As for the Mexican Flag thing… whew. What a touchy topic, huh? I don’t have a problem with people celebrating their various cultures- I think it’s great, actually.

I do, however (try as I might not to), get a little uncomfortable when that culture trumps our country.

      I’m torn, I guess.

      Anyway, thanks again!!

  3. No problem. I try not to beat on to many things here. You’ll here more and more in the coming days I’m sure. Some strong points and some weak. As far as her connection to La Raza. I’m sure you will see that come up. Its a very large organization with a lot of loose ends. She may be difficult for the GOP to counter, I imagine the opposition is going to come from the general public on this one. I could be wrong. It really is a bad situation for the GOP. Their base is going to slam them if they don’t oppose her and so they will oppose her. The fall out of them opposing her could be bad. They really painted themselves into this corner. I’m not flogging her yet. I’m a little ahead of the game on her but, I will wait and see what happens. Sometimes if you come out of the gate to strong, you are tired before the finish.
